E. Whiteland Outdoor, LLC (Off Premises Signs)

Below is a summary of the Conditional Use Applications, Zoning Ordinance Amendments, and Settlement Agreements related to off-premises signs on Route 30 and Route 202:

On February 13, 2019, E. Whiteland Outdoor, LLC (Applicant) filed three (3) Conditional Use applications to construct off-premises signs at three (3) locations along Lancaster Avenue in Frazer. Each application proposed a double-faced, electronic sign mounted to a freestanding monopole structure. The Applications are available for viewing below:

    2019-02-CU for 104-106 Lancaster Avenue

    2019-03-CU for 323 (East) Lancaster Avenue

    2019-04-CU for 32 Lancaster Avenue

Conditional Use hearings for these applications were held on January 15, 2020, January 29, 2020, and February 26, 2020. Over the following months, the Applicant granted the Township a series of extensions to carry these proceedings forward through the state-mandated timelines related to Conditional Use hearings. NOTE: The applications have been withdrawn per the terms of the approved Settlement Agreement (see below). 

In the meantime the Applicant commenced a lawsuit against the Township in the Chester County Court of Common Pleas related to the Township’s ordinances. The Applicant offered the Township a Settlement Agreement which would involve withdrawal of the three (3) pending applications and the construction of one (1) monument sign at the intersection of Rt. 29 and Rt. 30 (32 Lancaster Avenue). 

The proposed Settlement Agreement was approved by the Board of Supervisors at a public hearing on February 1, 2021 beginning at 7:00pm via the Zoom online meeting platform. Additional details regarding this hearing can be found in the legal notice below. 

The Applicant has proposed a Zoning Ordinance Amendment (both Text and Map) which would relocate the Township’s “billboard district” (the area in which off-premises signs would be permitted) from areas along Rt. 30 to an area along the south side of Rt. 202. The proposed Ordinance Amendments were adopted at a public hearing on February 1, 2021
